1. Acceptance of Terms

By accessing or using Calendinho, you agree to these Terms of Use. If you do not agree with any part of these terms, do not use the service.

Calendinho is operated by Axiom Technologies, based in São Paulo, Brazil. These terms constitute an agreement between you and Axiom Technologies.

2. Service Description

Calendinho is an online scheduling platform that allows professionals and small businesses to manage appointments. The service includes:

  • Event type creation and configuration
  • Weekly availability management and schedule overrides
  • Shareable public booking pages
  • Google Calendar sync
  • Automatic Google Meet link generation
  • Team management (collective availability, round-robin)
  • Email notifications (confirmations, reminders, cancellations)

3. Eligibility

To use Calendinho as a Professional (registered user), you must:

  • Be at least 18 years old or the legal age of majority in your jurisdiction
  • Provide truthful, complete, and up-to-date registration information
  • Have the legal capacity to accept these terms

Guests (people who book appointments) do not need to create an account but must provide valid information for the booking.

4. Account Registration and Security

  • You are responsible for maintaining the security of your account and for all activities under it
  • Authentication is managed by Clerk, our authentication provider. You can sign up with email/password or via Google OAuth
  • You must notify us immediately of any unauthorized use of your account
  • Do not share your login credentials with third parties

5. Acceptable Use

When using Calendinho, you agree not to:

  • Make fake or bulk bookings (spam)
  • Insert illegal, defamatory, or offensive content in custom fields, bios, or event descriptions
  • Collect or scrape data from other users through automated means
  • Impersonate another person or entity
  • Attempt to access accounts, systems, or data without authorization
  • Use the service for any illegal purpose
  • Interfere with the normal operation of the platform

We reserve the right to suspend or terminate accounts that violate these rules, with prior notice when reasonably possible.

6. Professional User Responsibilities

As a Professional using Calendinho, you act as a controller of the personal data of Guests who book through your page, under the LGPD. You are responsible for:

  • Having an adequate legal basis (Art. 7 of the LGPD) for collecting your Guests' data
  • Informing your Guests about how their data will be used
  • Responding to data subject requests (access, correction, deletion) regarding data collected on your behalf
  • Not using Guest data for purposes incompatible with booking
  • When configuring custom fields that involve sensitive data (e.g., health information), obtaining specific and prominent consent from Guests

7. Intellectual Property

  • Platform: Calendinho, including its code, design, brand, and features, is owned by Axiom Technologies. No intellectual property rights over the platform are transferred to you.
  • Your content: You retain ownership of all content you create on Calendinho (bios, event descriptions, custom fields). By publishing content on Calendinho, you grant us a limited, non-exclusive, revocable license to display that content on your public booking pages.
  • Feedback: Suggestions, ideas, or feedback you submit about the service may be used by us without obligation of compensation.

8. Pricing and Payment

Calendinho is currently offered free of charge.

Paid plans may be introduced in the future. In that case:

  • We will notify all users at least 30 days in advance
  • Specific pricing, billing, and cancellation terms will be presented before purchase
  • In accordance with Art. 49 of Brazil's Consumer Protection Code (CDC), consumers will have the right to withdraw within 7 days of purchasing any paid plan, with a full refund

9. Service Availability

  • Calendinho is provided "as is." We strive to maintain high availability but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated in advance when possible
  • We are not responsible for outages caused by third-party services (Google, Clerk, Vercel) or by factors beyond our control (force majeure)

10. Limitation of Liability

In accordance with Brazilian consumer protection law (CDC):

  • Our liability is limited to direct damages actually proven
  • We are not liable for indirect damages, lost profits, or data loss caused by circumstances beyond our reasonable control
  • Nothing in these terms excludes or limits our liability for willful misconduct, fraud, or violation of consumer rights established by law

We acknowledge that, under the CDC, the supplier is liable regardless of fault (strict liability) for defects in service provision.

11. Termination

  • By you: You may close your account at any time through Calendinho's settings. Your data will be handled as described in our Privacy Policy.
  • By us: We may suspend or terminate your account for violation of these Terms of Use, with prior email notice when reasonably possible, stating the reason and granting time for correction when applicable.
  • Effects of termination: After closure, your access to the service will be deactivated. Data from completed bookings will be retained for the period indicated in our Privacy Policy.

12. Changes to Terms

We may update these Terms of Use from time to time. In the event of material changes:

  • We will notify registered Professionals by email at least 30 days in advance
  • The updated version will be published on this page with the update date
  • Continued use of the service after the changes take effect constitutes acceptance of the updated terms
  • If you disagree with the changes, you may close your account before the effective date

13. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil.

The Courts of the District of São Paulo, State of São Paulo, are elected as the competent forum to resolve any disputes arising from these terms, waiving any other, however privileged.
